Docent Transmission Agreement

This Transmission Agreement forms part of Piyan Party's Terms and Policies. It sets out, in concrete terms, the categories, usages, purposes, approaches, and limits how or which of your data are being collected (for), and your obligation during your usage of Docent. Nothing here alters the consent you have already given to the Data Policy. You can find this Agreement in the full Terms and Policies.

Categories

  1. Your content means, in this Agreement:
    • your custom instructions and any saved prompt presets;
    • the messages you enter;
    • files you attach, and anything the software extracts from them;
    • the URLs of web pages you choose to submit, their contents, and anything the software extracts from them;
    • your messages from earlier turns and the replies you received, or summaries of them, including material not visible on screen (“context”; the conversation).
  2. Your data means, in this Agreement:
    • your content;
    • the record of your acceptance of this Agreement;
    • your preferences (including but not limited to reply language enforcement, theme, history keep period, and UI language);
    • API keys;
    • saved state;
    • data generated automatically while you use a platform or technology (unified logs, crash reports, and installation receipts, for example);
    • website permissions and audit metadata.

Purposes

  1. Docent is an application that forwards your content and your API key to an artificial intelligence (AI) service provider (the "provider" or "AI vendor"), so that a large language model (LLM) can process it — generating a response, or deriving search terms and querying the web — and returns the result for you to read.
  2. In certain builds you may opt into iCloud sync, so that your environment preferences follow you across devices.

Usages

  1. You acknowledge that, when you deliver unto Docent an API key, the same is stored in the Keychain of your own device. Strictly speaking, such storage is that which remains under your own control; Docent retains not the key thereof.
  2. Whilst you use Docent, your content and your API key travel over the Internet to the provider API endpoint or service module which you have configured (hereinafter “endpoint”).
  3. Docent includes a “test connection” feature, begotten for the purpose of swiftly proving, in the course of setup, whether a configuration be fit for use. When you make use thereof, there is sent unto the provider a standard request bearing fixed test text, the model name chosen by you, and your key.
  4. When once your content and API key have come unto an AI vendor, the terms and policies of that vendor govern the same; and such terms and policies may, or may not, provide for their use in the training of that vendor’s models. It is for you to read and understand the same before choosing a provider, to choose none save a provider whose terms you accept, and to make such settings as your purposes require. Many AI vendors provide means whereby the use of data for training may be refused; where such means exist, you understand that the setting thereof must be made by you, at the provider and not elsewhere.
  5. Your use of platform or technology is governed by the terms and policies of the provider thereof; and whatsoever data is generated in the course of such use is handled by whomsoever created the same, according to those terms and policies. Piyan Party retains no such data, neither is the same data collected by Piyan Party.
  6. Notwithstanding anything hereinbefore provided, when you choose on-device Apple Foundation Models, your content is processed locally and departs not from the device in question. Such model nevertheless stands in the place of a provider, and the clauses hereof which pertain thereto shall apply.
  7. For the service of your need to search the web, a provider whose service includes search may call upon a separate web search service or other external service. Where you choose such a provider, your content remains subject to the terms and policies of that provider.
  8. Your conversation history is saved automatically upon the device whereon you use Docent, and is retained and deleted according to the period appointed by you, or according to the manner in which Safari manages the use of local storage. If you enable any device backup technology, including without limitation iCloud or Time Machine, your data may by that means pass forth from the device and become subject to the terms and policies of such technology.
  9. Your preference settings are stored locally; save that, in certain builds, the same may also be stored in the CloudKit storage of your own Apple Account.
  10. Docent stores the record of your acceptance of this Agreement. You may clear the same by means of the bundled uninstall helper and by following the steps thereupon shown unto you.

Limits

  1. As regards the transmission whereof this Agreement speaks, you understand that neither Docent nor Piyan Party is an AI vendor, and that neither uses nor retains your data. Your content is transmitted and displayed solely by the copy of Docent which Piyan Party has supplied and licensed unto you, and which you yourself operate; Piyan Party handles neither your content nor your API key.
  2. You may supply none save such content as you have the right to supply.
  3. Without prejudice to the generality of all that is hereinbefore set forth, if you point Docent at a proxy, gateway, intermediary service, self-hosted service, or any other endpoint not directly provided by a built-in AI vendor, your content and API key may likewise be received, processed, or retained by whomsoever operates that endpoint. It is for you to understand and accept the data-handling practices, terms, and policies which apply thereto. Docent connects according to the endpoint information which you supply or select, and refuses redirects, including but not limited to HTTP 301, 302, 303, 306, 307, and 308. Thereupon, you bear sole responsibility for confirming that every endpoint or model which you enter or alter is indeed the service which you intend to use; and if, by reason of an error in your configuration, data be sent unto another destination or processed by a different software, such transmission shall nevertheless be deemed one made upon your instruction.
  4. You may at any time delete individual conversations, clear all local storage, or manage your data by means of your own device backups. Yet the deleting of conversation history, the clearing of local storage, the ceasing of your use of Docent, the changing of your provider and/or model selection, and the uninstalling of Docent shall none of them revoke, delete, or alter data already backed up or already transmitted unto a provider.
  5. Neither Docent nor Piyan Party has power over that which a provider actually does with your content after the same has come unto it; neither may exercise on your behalf any right of access, deletion, training opt-out, or otherwise you hold against that provider. Where a provider advertises “no storage,” “no training,” “zero data retention,” or any like matter, the same is a representation made by that provider unto you; Piyan Party makes no comment thereupon.
  6. For completeness, when a connection is made over the Internet, the endpoint and network service providers may obtain IP addresses, connection times, user-agent information, and other communications metadata, as networks ordinarily do; Piyan Party collects none thereof. You further acknowledge that the modern Internet is borne upon data centres and content delivery networks (CDNs) spread across the world; and unless you choose an on-device model service module or endpoint, or unless your chosen provider expressly guarantee otherwise, the geographic region wherein your data is handled may not be capable of being constrained. This is expressly set forth, lest the same should not already be known unto you as common sense.
  7. If any provision of this Agreement be held invalid, the provisions which remain shall stand in full force. Whatsoever not addressed herein shall be governed by Piyan Party's Terms and Policies.

Observance

  1. This Transmission Agreement is made with you personally. You acknowledge that your use of Docent’s data-transmission features may be subject to restrictions imposed by third parties and not herein expressly set forth, including, without limitation, platform policies, provider terms, and the law of the place wherein you are, for example. Without limiting the generality of the foregoing, if you or your content be subject to rules imposed by another person, an organisation, or the law, including without limitation restrictions upon cross-border transfer, you represent that you use Docent upon the footing that you comply with the same.
  2. The use of an AI vendor’s service may consume your paid credits, usage quota, or other resources, or incur charges. All charges and usage limits arising therefrom are matters between you and that provider.
  3. As with the remainder of the Terms and Policies, you agree that Piyan Party may amend this Agreement and the policies related thereto without notice unto you. You hereby accept the most recent version of the terms, whether you have read the same.
